Shumaker, Loop & Kendrick, LLP Prevails in 6th Circuit Federal Court of Appeals

COLUMBUS, OH –  Jamie Colner, litigation partner in Shumaker, Loop & Kendrick, LLP’s Columbus office, and Adam Galat, a Columbus associate, were part of a legal team that won a significant victory in the 6th Circuit Federal Court of Appeals, reversing a judgment rendered on claims under the Federal Lanham Act, Federal and Ohio trade secrets acts, conversion and breach of warranty claim. The legal team included Ronald Hull and Thomas Knab from the Rochester, New York firm of Underberg & Kessler.

The case, Kehoe Component Sales, Inc. et al v. Best Lighting Products, Inc., arose out of the termination of a business relationship between the manufacturer and seller of emergency exit signs and lights. Our client, Kehoe Component Sales, filed suit against Best to collect close to $900,000 owed for products sold to Best. Best filed a counterclaim seeking damages for alleged violations of the Lanham Act, Trade Secret statutes, breach of warranty on the products sold, conversion, tortious interference and breach of contract. Following a bench trial, the trial court found in favor of Best on all of its claims and awarded $1,700,000 in compensatory damages, $200,000 in punitive damages and attorney fees of over $895,000. The trial court also reduced Pace’s collection claim by $318,000 for breach of warranty.

In obtaining the reversal of the Lanham Act, trade secret claims, conversion, breach of warranty claim and the attorney fees award, we saved our client over $1,500,000.

Adam practices in the areas commercial litigation and appellate advocacy. He joined the firm after having served as a judicial clerk at the trial and appellate levels. He has extensive experience in briefing and arguing appeals before the state and federal courts.
