Practicing in the Employee Compensation & Benefits practice group of Shumaker, Loop & Kendrick, LLP, Dave focuses on single and multiemployer retirement and health and welfare plans, executive compensation, and other benefits-related matters such as:

  • Drafting restated plan documents, plan amendments, summary plan descriptions, summaries of material modification, and various administrative policies and procedures.
  • Assisting with the preparation and filing of applications with the Department of Labor (Voluntary Fiduciary Correction Program), IRS (plan determination letters, Employee Plan Compliance Resolution System corrections, determinations upon plan termination), and Department of Treasury (benefit suspension under the Multiemployer Pension Reform Act of 2014).
  • Assisting clients with IRS or Department of Labor audits of their benefit plans.
  • Advising multiemployer plans regarding the assessment and collection of delinquent contributions and employer withdrawal liability.
  • Advising clients on best practices in the administration of their benefit plans, including loan and hardship withdrawal administration, participant communications and statements, and navigating beneficiary disputes.

Dave also provides guidance on the division of retirement assets in domestic relations and child support proceedings. He has a substantial amount of experience both drafting and reviewing Qualified Domestic Relations Orders to ensure that they meet qualification requirements under federal law.

As an undergraduate student at Baldwin-Wallace University, Dave double majored in business administration and creative writing. After graduating cum laude, he moved back to Toledo to work as an editor for his family’s business, American Recycler Newspaper, a monthly trade publication with circulation throughout the U.S. and Canada. While working at the newspaper full time, Dave also attended the University of Toledo College of Law as a night student. There, he served as an executive editor on the University of Toledo Law Review, and graduated with honors.

Currently volunteering with the Reentry Coalition of Northwest Ohio, Dave uses his prior experience as a legal intern in the Public Defender’s office to help recently-released individuals obtain a valid driver’s license. He enjoys visiting the Toledo Zoo and the Toledo Museum of Art with his wife and son, and taking their dogs for walks in the Metroparks of the Toledo Area. Dave plays a mean game of euchre, and is an avid scuba diver when he gets a chance to travel somewhere warm.
